The Motor Industry Staff Association (MISA) is a fast growing, registered Trade Union organising within the Retail Motor Industry. This dynamic trade union provides its members with a well-versed negotiating team as well as peace of mind through the provision of a variety of benefits ranging from labour related legal assistance and financial support by way of numerous monetary benefits.
We are seeking a Senior Labour Advisor to join our growing organisation.
A Degree in Labour Law and 3 years’ Labour Relations experience is required. The applicant must have sufficient knowledge of grievance processes, S189 and S189A processes, representation and mediation at disciplinary hearings as well as at conciliations and arbitrations. Applicants must possess at least 2 years’ arbitration experience.
Must be able to hit the ground running and deal with pressure from day one!
Responsibilities:
Member Representation/Legal Advice:
- Represent members at Disciplinary Hearings, Retrenchment Proceedings, Conciliations and Arbitrations.
- Provide legal advice and/or representation to MISA members with regard to disciplinary hearings, workplace conflict, retrenchment processes and grievance disputes.
Reporting:
- The SLA will report directly to the Manager: Legal Department.
Arbitrations:
- Representation of members during arbitrations at the Dispute Resolution Centre (DRC) and/or the CCMA.
Attendance and Reporting on:
- Disciplinary Hearings
- Appeal Hearings
- Grievances
- Retrenchments
- Conciliation
- Arbitration
Member Satisfaction:
- Interact and resolve queries from members.
Reporting and Accountability:
- The SLA will be held responsible for any/all decisions once it is made.
- The SLA will maintain an open and honest channel of communication with the Manager: Legal Department at all times.
- Any question that falls outside of the SLA’s responsibilities must be referred to the Manager: Legal Department for a decision and/or guidance.
Minimum Requirements:
- LLB
- Three (3) years’ experience in Labour Law and/or litigation and at least 2 years’ arbitration experience.
- Good command of English and fluent in a South African indigenous language, preferably Zulu.
- Computer literacy with basic knowledge of Excel, Microsoft Word and Windows Outlook
- Experience in arbitrations is compulsory.
- Advanced understanding and/or experience interpreting employment contracts and agreements.
- Dealing with conflict and grievance resolution.
- Experience in a trade union environment will be an advantage.
- Collective bargaining and health and safety/employee wellbeing.
- Knowledge of the structures within the motor industry will be an advantage.
- A valid driver’s licence.
- Willing and able to travel extensively and on short notice.
- Skilled in daily Planning and Administration.
